Terms of Service

These Terms of Service ("Terms") govern your use of the Klug app ("App"), provided by Klug ("we", "us", "our"). By using the App, you agree to these Terms.

1. Description of Service

Klug is a German language learning application that provides structured lessons, vocabulary exercises, spaced repetition review, and AI-powered conversation practice. Some features use artificial intelligence to generate responses.

2. AI-Generated Content

Portions of the App use artificial intelligence (AI) to generate educational content, including but not limited to:

• Responses from the AI Teacher chat
• Conversations in Speaking Buddy practice
• Personalized learning suggestions

AI-generated content may contain errors. It is provided for educational purposes only and should not be relied upon as authoritative language instruction. We do not guarantee the accuracy, completeness, or pedagogical correctness of AI-generated content.

3. Account and Data

• You may use the App without creating a formal account. An anonymous identifier is generated locally on your device.
• Your learning progress, preferences, and notes are stored locally on your device.
• Your credit balance and purchase history are synced securely via Firebase cloud services.
• If you delete the App or its data, local progress cannot be recovered. Cloud-synced data (credits, account) can be restored by signing in again.

4. Credits and Purchases

• The App uses a credit system for AI-powered features.
• New users receive a one-time welcome bonus of free credits.
• Additional credits can be purchased as one-time packs or through subscription plans.
• All purchases are processed through Apple's App Store and are subject to Apple's terms and refund policies.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel subscriptions in your Apple ID account settings.
• Credits are non-transferable and have no cash value.

5. Subscription Terms

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
• You can manage and cancel subscriptions by going to your Account Settings on the App Store after purchase.
• No cancellation of the current subscription is allowed during the active subscription period.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to manipulate the credit system or exploit bugs
• Reverse engineer, decompile, or disassemble the App
• Use the AI features to generate harmful, abusive, or inappropriate content
• Circumvent any access controls or usage limits

7. Intellectual Property

All content, design, and code in the App are owned by Klug or its licensors. Curriculum content, lesson materials, and the App's design are protected by copyright. You may not reproduce, distribute, or create derivative works from the App's content.

8. Disclaimers

• The App is provided "as is" without warranties of any kind.
• We do not guarantee uninterrupted or error-free operation.
• AI features depend on third-party AI providers and may be unavailable at times.
• The App is not a substitute for formal language instruction.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data or learning progress.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We will notify you of material changes through the App.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms.

12. Contact

For questions about these Terms, please use the "Report an Issue" feature in the app (Profile → Settings → Report an Issue) and select "General Feedback".

13. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be addressed through informal negotiation. If unresolved within 30 days, disputes shall be submitted to mediation before pursuing other remedies. You may contact us through the in-app feedback system to initiate dispute resolution.

14. Governing Law

These Terms are governed by the laws of Switzerland, without regard to conflict of law provisions.
